Brian was invited by South China Morning Post to comment on ByteDance’s report legal challenge against the Presidential Executive Order prohibiting its US TikTok/Musical.ly business from entering in transactions with US persons. I believe that there are tactical reasons for the challenge in light of the second Executive Order requiring the sale of those US assets by Bytedance: a US business with whom no US persons are allowed to enter into as yet unascertained transactions is worth much less than one that is operating without such a prohibition.
